1. Introduction

These Terms of Service govern your use of Moondane, our spending tracking application, website, and related services (collectively, the "Service").

By using the Service in any way, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction) and legally able to enter into these Terms.

• You are responsible for all activity under your account.

3. Acceptable use

Moondane is designed for personal budgeting and spending insights. You agree not to misuse the Service or interfere with others' use of it.

• Use the Service only for lawful, personal, non-commercial purposes.
• Do not attempt to access data you do not own, probe or disrupt the Service, or reverse-engineer our software.
• Do not upload harmful code, inaccurate data meant to mislead, or content that violates others' rights.
• Respect our intellectual property and the privacy of others; do not scrape, resell, or frame the Service.

4. Subscriptions, payments, and refunds

Moondane may offer free features and optional paid plans that provide enhanced functionality. Prices, billing periods, and features are shown in the app and may change prospectively.

• Purchases are processed through the Apple App Store; recurring subscriptions renew automatically unless cancelled at least 24 hours before the period ends.
• You can manage or cancel subscriptions through your App Store account. Deleting the app does not cancel a subscription.
• Refunds are handled by the platform according to App Store policies unless required by law.

5. Intellectual property

Moondane, including its software, design, and trademarks, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal budgeting in accordance with these Terms. You own your data; you grant us the rights necessary to operate the Service, including storing, processing, and visualizing your information.

6. Third‑party services and links

The Service may rely on third-party services (such as app store payment processors, cloud hosting, or optional financial data providers). Their terms and privacy practices apply to their services. We are not responsible for third-party content or policies; use them at your own discretion.

7. Disclaimers and limitation of liability

The Service is provided "as is" and "as available." Moondane offers budgeting insights for informational purposes only and does not provide financial, legal, or tax advice. We do not guarantee that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, our total liability for any claims arising from the Service is limited to the amount you paid for the Service in the twelve months before the claim or $50, whichever is greater.

8. Term and termination

These Terms apply while you use the Service. You may stop using the Service at any time and can delete your account in the app or by contacting us. We may suspend or terminate access if you violate these Terms, if required by law, or for security reasons. Upon termination, your right to use the Service ends, but certain provisions (including intellectual property, disclaimers, and limitations of liability) will survive.

9. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction. If you are a consumer in a jurisdiction that requires different rights or forums, those rights remain in effect.

10. Changes to these Terms

We may update these Terms to reflect changes to the Service or legal requirements. If we make material changes, we will provide notice in the app, on the website, or by email. Updated Terms take effect when posted; continued use of the Service after the effective date means you accept the changes.
